Age discrimination is a protected characteristic under the Equalities Act 2010. There are a number of ways to fall foul of this legislation during the employment relationship.
- Recruitment advertising referring to candidates as young potentials.
- Not promoting an older employee as they are seen as unambitious and unlikely to leave for a new role elsewhere.
- Disregarding parts of a standard process within the business, ie regular reviews when an employee reaches a specific age or length of service or seeking to create a situation where an employee does not get their entitled pension enhancement.
- Failing to treat performance issues in the same way for all employees and keeping records agreeing improvement plans.
- Making age related assumptions, ie physical abilities, even if those assumptions turn out to be correct.
